When can SARA handle disputes?

If an agreement between the parties incorporates an arbitration clause reading, for example, as follows: ?All disputes arising out of or in connection with this agreement will be settled by the Court of Arbitration of the Audiovisual Market at the Polish Audiovisual Producers Chamber of Commerce in Warsaw in accordance with the rules of that Court prevailing on the date of filing the statement of claim?.

This condition applies both to agreements executed between business entities, as well as to agreements concluded between a producer and individuals, specifically an author, artist, performer or a service provider.

In respect of agreements that came into effect before the court was established, an arbitration clause can be incorporated in an annex to any such agreement.

If there is no arbitration clause in the agreement or an annex thereto, the parties may submit to the Court of Arbitration of the Audiovisual Market at KIPA a written statement submitting a specific ? already existing ? dispute to this Court for resolution through arbitration (i.e. a compromise).
